The Pennsylvania laws that affect your IT.
A breach, a privacy request or an auditor's question lands differently in every state. Here is what Pennsylvania asks of businesses that hold its residents' data.
Data-breach notification
- The law
- Breach of Personal Information Notification Act, 73 P.S. § 2301 et seq. (Act 94 of 2005), as amended by Act 151 of 2022 and Act 33 of 2024 (effective Sept. 26, 2024)
- Telling affected people
- "without unreasonable delay" after determination of the breach, subject to law enforcement delay and measures needed to determine scope and restore system integrity. State agencies, counties, public schools and municipalities must notify within seven business days.
- Regulators
- Office of Attorney General: required when more than 500 Pennsylvania residents are affected, "concurrently" with notice to individuals (added by Act 33 of 2024). The notice must include the organization's name and location, breach date, summary and estimated number affected. Insurers subject to the Insurance Data Security Act (40 Pa.C.S. Ch. 45) are exempt.
- Credit bureaus
- Required, without unreasonable delay, when notice is provided to more than 500 persons at one time (lowered from 1,000 by Act 33 of 2024). If the breach involves a name plus SSN, bank account number, or driver's license or state ID number, the entity must also offer one free independent credit report and 12 months of free credit monitoring.
- Encrypted data
- Encrypted data is generally exempt (a safe harbor), unless the key was also compromised.
Consumer privacy law
Pennsylvania has no comprehensive consumer privacy law in effect. HB 78 (Consumer Data Privacy Act) passed the House on Oct. 1, 2025 and was amended and reported 11-0 by the Senate Communications & Technology Committee on June 24, 2026. As of its last recorded action (Oct. 6, 2026), it was pending on the Senate calendar and had not passed the Senate or been signed into law.
