Terms of Use
The rules for using this website and our text support line. Client services are covered by your service agreement.
Effective date: 2026-10-17 · Last updated: 2026-10-18
These Terms of Use (“Terms”) are an agreement between you and TenacIT, LLC (“TenacIT,” “we,” “us,” or “our”). They govern your use of www.tenacit.com and its subdomains (the “Site”) and our TenacIT Technical Support Messages text program. Our client portal at support.tenacit.com is not part of the Site for these Terms; it is governed by the client’s service agreement with TenacIT and the portal provider’s terms. By using the Site or texting our support line, you agree to these Terms. If you do not agree, please do not use the Site or the text program. You must be at least 18 years old to use the Site.
Our Privacy Policy explains how we collect, use, and protect personal information, and is incorporated into these Terms by reference. If you use the Site on behalf of an employer or other organization, you represent that you are authorized to accept these Terms for that organization.
These Terms do not govern the IT, help desk, security, or consulting services we provide to clients. Those services are governed by the written service agreement between TenacIT and the client, which controls if it conflicts with these Terms, except that Section 8 (Text messaging) always applies to text messages.
1. Copyright and Site content
The Site and its content, including text, graphics, logos, images, video, software, and the selection and arrangement of that content, are owned by or licensed to TenacIT and are protected by copyright and other intellectual property laws.
You may view, download, and print Site content for your own non-commercial, internal use or use within your organization, provided you keep all copyright and other notices intact and do not separate any logo from its accompanying text. Any other use, including reproducing, modifying, republishing, distributing, framing, or mirroring the Site or its content, requires our prior written permission.
2. Trademarks
TenacIT and the TenacIT logos are trademarks of TenacIT, LLC. Other trademarks, service marks, and logos on the Site belong to their respective owners. Nothing on the Site grants any license to use any trademark without the written permission of its owner.
3. Third-party links
The Site links to third-party websites and services, such as social media. These links are provided for convenience and do not mean we endorse or are affiliated with the third party unless we say so. We do not control third-party sites and are not responsible for their content, availability, or privacy practices. Your use of them is governed by their own terms and privacy policies.
4. Remote-support software
The Site provides a download link for remote-support software used by TenacIT technicians. Remote support is available only to active TenacIT clients with a signed service agreement. Download and run the software only when a TenacIT technician asks you to as part of a support request. A remote session starts only with your consent, and you can end it at any time. Before a session starts, please close windows and documents unrelated to your request. The software is provided by its vendor and is subject to the vendor’s license terms.
Beware of impersonators. TenacIT never makes unsolicited calls or sends unsolicited messages asking you to install software or give us remote access. If you receive one claiming to be from TenacIT, do not install anything, and contact support@tenacit.com or call 1-878-787-7678.
5. Submissions and communications
Personal information. Personal information you send us, whether through our contact form, by email, by phone, or by text message, is handled as described in our Privacy Policy. Submissions and support communications may be processed by business AI-enabled tools as described in our Privacy Policy.
Passwords and sensitive information. Do not include passwords, payment card numbers, or other sensitive information in the contact form, emails, support tickets, or text messages. TenacIT will never ask you to send us your password by text message or email.
Other submissions. Comments, feedback, ideas, and suggestions you submit to us through the Site are non-confidential. You grant TenacIT a non-exclusive, royalty-free, perpetual, worldwide license to use them to operate and improve our Site and services, without any obligation to you. Please do not send confidential or proprietary information through the Site’s contact form. Clients should submit support requests to support@tenacit.com, through the client portal, or, for clients with an active managed services agreement, by texting TenacIT’s text support number.
Your responsibility. You are responsible for what you submit. You may not submit anything that is unlawful, defamatory, threatening, harassing, obscene, or infringing; that contains malware; or that encourages conduct that would be a criminal offense or give rise to civil liability. We may remove any submission at our discretion.
6. Acceptable use and security reporting
You agree not to: use the Site in violation of any law; attempt to gain unauthorized access to the Site, our systems, or any client system; probe, scan, or test the Site’s vulnerabilities without our written authorization; interfere with the Site’s operation or security; use automated means to scrape or collect data from the Site; or impersonate any person or misrepresent your affiliation.
If you believe you have found a security vulnerability in the Site or our systems, please report it to security@tenacit.com and do not access, change, or share any data. We appreciate good-faith reports.
7. Monitoring and cooperation with authorities
We may, but are not obligated to, monitor submissions and use of the Site. We may disclose information, including the identity of a person who submitted content, when required by law, subpoena, or court order, or as otherwise described in our Privacy Policy.
8. Text messaging (SMS): TenacIT Technical Support Messages
TenacIT Technical Support Messages is a text-message support line available only to clients with an active managed services agreement. We use it only to reply to technical support requests you start by texting TenacIT’s text support number. We do not send marketing or promotional text messages, and we do not text you unless you have texted us first.
How you opt in. When you send a text message to TenacIT’s text support number, you agree to receive replies from TenacIT about your support request, such as troubleshooting steps, ticket updates, and appointment confirmations. Consent to receive text messages is not a condition of purchasing any service. You must be at least 18 years old and the account holder of the mobile number, or have the account holder’s permission.
Frequency and cost. Message frequency varies based on your support requests. Message and data rates may apply; contact your wireless provider for details about your plan.
Opting out. Reply STOP, END, CANCEL, QUIT, UNSUBSCRIBE, REVOKE, or OPT OUT at any time to opt out. You will receive one message confirming your opt-out and no further messages unless you opt in again. Reply START to resubscribe. You may also opt out by telling us in any other reasonable way, such as by email or phone.
Help. Reply HELP for help, or contact support@tenacit.com or call our support line at 1-878-787-7678.
Carriers are not liable for delayed or undelivered messages.
Privacy. We handle your information as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties.
9. No professional advice or client relationship
Content on the Site is general information, not legal, accounting, security, or compliance advice for your situation. Using the Site, submitting the contact form, or contacting us does not create a client relationship; that relationship begins only when TenacIT and the client sign a written service agreement. TenacIT is not a CPA firm and does not issue SOC 1 or SOC 2 audit reports; we help clients prepare for audits performed by independent auditors. We do not guarantee any particular security or compliance outcome.
10. Disclaimers
THE SITE, ITS CONTENT, AND ANY DOWNLOADS FROM IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” FOR GENERAL INFORMATION ONLY. THE SITE MAY CONTAIN INACCURACIES OR TYPOGRAPHICAL ERRORS, AND WE MAY CHANGE ITS CONTENT AT ANY TIME WITHOUT NOTICE. TO THE FULLEST EXTENT PERMITTED BY LAW, TENACIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TENACIT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE SITE, ITS CONTENT, OR ANY DOWNLOADS FROM IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL OTHER CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
NOTHING IN THESE TERMS LIMITS OR EXCLUDES ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD OR FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR ANY RIGHTS YOU HAVE AS A CONSUMER THAT CANNOT BE WAIVED. THESE LIMITS DO NOT APPLY TO SERVICES PROVIDED UNDER A CLIENT SERVICE AGREEMENT, WHICH CONTAINS ITS OWN TERMS.
12. Indemnification
You agree to indemnify and hold harmless TenacIT and its affiliates, officers, employees, and agents from third-party claims, losses, and expenses, including reasonable attorneys’ fees, to the extent they arise from your violation of these Terms, your submissions, or your misuse of the Site.
13. International use and export controls
The Site is operated from the United States. You may not use the Site, or download software from it, in violation of U.S. export control or sanctions laws, or if you are located in a country or region subject to comprehensive U.S. sanctions or are a person on a U.S. government restricted-party list.
14. Termination
We may suspend or end your access to the Site at any time if you violate these Terms. Sections 1, 2, 5, 9 through 13, 15, and 17 survive termination.
15. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction. Nothing in this section removes any right you have as a consumer to bring a claim in the courts where you live, where that right cannot be waived.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page and change the “Last updated” date. If we make material changes, we will provide additional notice, such as a notice on the Site, before they take effect. Your continued use of the Site after the effective date means you accept the updated Terms. Changes to how we handle personal information are made as described in our Privacy Policy.
17. General
Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and TenacIT about the Site and the text program. Client services are governed by the client’s service agreement.
Severability. If any part of these Terms is found unenforceable, the rest remains in effect, and the unenforceable part will be enforced to the greatest extent allowed.
No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of all or part of our business.
Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, power or internet outages, or actions of service providers or governments.
Electronic communications. By using the Site or contacting us electronically, you agree that we may communicate with you electronically, and that electronic notices and agreements satisfy any requirement that they be in writing. Legal notices to TenacIT must be sent to info@tenacit.com and to our mailing address below.
